AIR BAGS:FRONTAL:DRIVER SIDE:INFLATOR MODULE

BMW of North America, LLC (BMW) is recalling certain 2008-2013 128i and 135i Convertibles, 128i, 135i, and M Coupes, 2007-2010 X3 30si and X3 xDrive30i, 2013-2015 X1 sDrive28i, X1 xDrive28i and X1 xDrive35i, 2007-2013 328i, 328i xDrive, 335i, 335is, 335i xDrive and M3 Coupes, 2006-2011 328i, 328xi, 328i xDrive, 325i, 325xi, 330i, 330xi, 335i, 335xi, 335i xDrive and M3, 2009-2011 335D, 2006-2012 325xi, 328i, 328xi and 328i xDrive, 2010-2011 X6 ActiveHybrid, 2007-2013 328i, 335i, 335is, M3 Coupes, X5 30si, X5 xDrive30i, X5 xDrive35i, X5 48i, X5 xDrive48i, X5 xDrive50i and X5 M, 2009-2013 X5 xDrive35d and 2008-2014 X6 xDrive35i, X6 xDrive50i and X6M vehicles equipped with non-desiccated driver frontal air bag inflators containing phase stabilized ammonium nitrate (PSAN) that were used as interim remedy parts for previous Takata recalls. These inflators may explode due to propellant degradation occurring after long-term exposure to high absolute humidity, high temperatures, and high temperature cycling.

Fix: BMW will notify owners, and dealers will replace the driver air bag. On X5 and X6 vehicles, only the inflator will be replaced. All repairs will be performed free of charge. The recall began March 11, 2020. Owners may contact BMW customer service at 1-800-525-7417.

AIR BAGS:SENSOR:OCCUPANT CLASSIFICATION

BMW of North America, LLC (BMW) is recalling certain 2006-2010 BMW X3 2.5i, X3 3.0i and X3 xDrive30i Sports Activity Vehicles. The front passenger seat occupant detection mat that determines if, and how, the passenger frontal air bag should deploy in a crash may fatigue and develop cracks which could lead to a system failure.

Fix: BMW will notify owners, and dealers will replace the front passenger seat occupant detection mat, free of charge. Interim owner notification letters were mailed on November 27, 2017. A second notification letter will be sent when parts are available. Owners may contact BMW customer service at 1-800-525-7417.

After your 2007 BMW X3 had a Takata airbag recall repair performed at BMW of Manhattan, an airbag warning light appeared on your dashboard—even though no warning lights were present before the service. The dealership says the warning light is unrelated to their work and is your responsibility to fix, but the problem only started after they serviced the airbag system. You're concerned about the safety implications and want the dealer to perform a diagnostic scan at no cost to determine whether their installation caused the issue. Resolving this will likely require the dealership to diagnose the SRS system with specialized equipment and potentially reinstall or replace airbag components.

Your 2007 BMW X3 was involved in a T-bone crash at approximately 40 MPH, and the front driver and passenger airbags failed to deploy during impact. Both the driver and front passenger sustained significant injuries including head, neck, back, and internal injuries as a result. A police report was filed and the vehicle was towed; BMW was notified of the failure. Repairing this issue would require BMW to diagnose why the airbag system failed to trigger and replace or repair the faulty airbag control module and possibly the airbags themselves.

I CALL THE BROOKLYNBMW DEALER TO SCHEDULE A RECALL REPAIR ON THREE ITEMS FOR MY TRUCK AND I WAS TOLD IT WOULD TAKES DAYS FOR THE REPAIRS AND I WOULD HAVE TO GET MY OWN MEANS OF TRANSPORTATION DURING THIS TIME EVEN AFTER I STATED I HAVE AN ELDERLY MOTHER WHOM LIVES WITH ME AND THAT I WOULD NEED SOME TYPE OF TRANSPORTATION DURING THAT TIME AND WAS TOLD THERE WAS NO LOANER CAR TO OFFER ME AND THAT I WOULD HAVE TO PAY $40 A DAY FOR A RENTAL CAR. THIS IS AN INCONVIENCE SINCE I SHOULD NOT BE RESPONSIBLE FOR OUT OF POCKET EXPENSE FOR THE COMPANYS NEGLIGENCE OF DEFECTIVE/CHEAP/RECALLED AUTO PARTS. FOR OVER A YEAR NOW THE AIRBAG LIGHT ON THE DASHBOARD HAS BEEN GOING ON AND OFF. ORIGINALLY, IT WAS ONLY TURNING ON WHEN I HAD A PASSENGER IN THE FRONT SEAT. NOW IT TURNS ON WITH OR WITHOUT A PERSON SO I'M STARTING TO THINK THAT THE DRIVERS SIDE IS MALFUNCTIONING TOO. IN ADDITIONAL THE SEATBELT LIGHT IS TURNING ON TOO NOW. THIS IS VERY FRUSTRATING. I TALKED TO THE DEALERSHIP AND THEY INDICATED THAT IT IS THE AIRBAG AND SEAT SENSORS THAT HAVE MALFUNCTIONED. EACH TO FIX IS OVER $500. THEY ALSO INDICATED THAT THIS IS A COMMON PROBLEM FOR OWNERS AND TO WAIT FOR A SUPPOSABLY RECALL LETTER. HOWEVER, THAT WAS A YEAR AGO AND I NOW HAVE THE AIRBAG AND SEATBELT LIGHT GOING OFF. I'VE ALSO COME ACROSS MANY BMW FORUMS (OWNERS) TALKING ABOUT THEIR FRUSTRATION WITH THESE SAME ISSUES. IT'S SURPRISING THAT THE DEALERSHIPS ACKNOWLEDGE THE ISSUE BUT YET NOTHING IS BEING RESOLVED. THERE HAS TO BE A REMEDY FOR THIS ANNOYANCE AND LACK OF ACKNOWLEDGEMENT BY BMW. IF ANYTHING THERE HAS TO BE SOME REPERCUSSIONS ON BMW'S PART SINCE THE CONSUMERS ARE HAVING TO DEAL WITH THESE PROBLEM FOR WHAT SEEMS TO BE YEARS NOW.

THE VEHICLE WAS NOT DIAGNOSED OR REPAIRED. THE MANUFACTURER WAS NOTIFIED AND INFORMED THE CONTACT THAT SHE MUST SHIP THE VEHICLE TO HONOLULU, HI TO AN AUTHORIZED BMW DEALER AT HER EXPENSE. THE MANUFACTURER FURTHER STATED THAT SHE WOULD BE REIMBURSED WHEN THE RECALL REPAIRS WERE COMPLETED. ADDITIONALLY, THE MANUFACTURER CONFIRMED THAT SOME OF THE PARTS WERE NOT AVAILABLE .THE CONTACT DECLINED TO SHIP THE VEHICLE TO HONOLULU DUE TO FUNDS NOT BEING AVAILABLE. THE ISSUE IS THAT I NEED MY CAR AND THE FRONT SEAT PASSENGER AIRBAG SENSOR IS NOT WORKING PROPERLY. I HAVE RECEIVED DOCUMENTATION FROM TAKATA AND BMW THAT THERE CURRENTLY IS NO REMEDY. MY QUESTION IS SINCE I AM STILL DRIVING MY CAR, IF I WERE IN AN ACCIDENT, IS THE LIABILITY OF MY PASSENGER MY RESPONSIBILITY? I CANNOT LET THE CAR SIT PARKED UNTIL A REMEDY IS AVAILABLE AS THIS WOULD RUIN THE CARS ENGINE. BMW AND TAKATA HAVE NO REMEDY AND HAVE GIVEN NO ETA WHEN ONE WOULD BECOME AVAILABLE. THE COMPLAINT I HAVE IS THAT THE RISK SHOULD BE ELIMINATED BY CORRECTLY REPAIRING THE ISSUE, NOT TO JUST "REDUCE THE RISK." I GOT INTO AN ACCIDENT AND THE AIRBAGS DIDN'T EVEN DEPLOY, I COULD HAVE BEEN KILLED . I AM SEEKING LEGAL HELP. I WANT A REPLACEMENT VEHICLE OR I AM GOING TO COURT AND THEY CAN HAVE THIS PIECE OF CRAP BACK. NOW I HAVEN'T BEEN DRIVING MY CAR FOR THE PASS COUPLE OF MONTHS BECAUSE THEY CLAIM THAT MY AIRBAGS CAN DEPLOY AT ANYTIME WITH METAL FRAGMENTS THAT CAN KILL ME, AND POSSIBLY KILL MY DAUGHTER IF SHE IS IN THE CAR WITH ME. THE DRIVER RESPONSIBLE FOR THE CRASH SIDE SWIPED ANOTHER VEHICLE AND THEN CROSSED OVER TO THE FAR RIGHT LANE STRIKING THE VEHICLE, THE CONTACT WAS IN AND ROLLED OVER. NONE OF THE AIR BAGS DEPLOYED. THE VEHICLE WAS TOWED TO A SALVAGE YARD WHERE IT WAS DEEMED DESTROYED. A POLICE REPORT WAS FILED. THE MANUFACTURER WAS NOT NOTIFIED OF THE FAILURE. THERE WERE TWO INJURIES THAT REQUIRED MEDICAL ATTENTION THE CONTACT'S LEFT HAND WAS CRUSHED AND REQUIRED FOUR SURGERIES. THE CONTACT ENDURED ONE AND A HALF YEARS OF OCCUPATIONAL THERAPY, POST CONCUSSION BRAIN DAMAGE, AND PTSD THERAPY. DUE TO THE CRASH, THE CONTACT NO LONGER HAD PROPER FUNCTIONALITY OF THE LEFT HAND. THE AIRBAG LIGHT IN THE DASH FLASHES ON AND OFF RANDOMLY WHETHER THERE IS SOMEONE IN THE SEAT OR NOT. IT DOES NOT MATTER WHETHER THE PASSENGER SIDE SEAT BELT IS FASTENED OR NOT. BMW HAS A RECALL FOR EARLIER YEARS OF THIS SAME PROBLEM ON THIS VEHICLE, BUT NOT FOR THIS YEAR WHICH ALSO HAS QUITE A FEW OF THESE FAILURES. AS I MOVED IN TO THE NEXT LANE TO GO AROUND HIM, I SAW THERE WAS A PRE-EXISTING MULTI-CAR ACCIDENT THAT HAD JUST OCCURRED IN THAT LANE RIGHT IN FRONT OF ME. I IMMEDIATELY SLAMMED ON MY BRAKES TO AVOID ADDING TO THE MESS. I WAS ABLE TO STOP IN TIME. I HAD ZERO CONTACT WITH ANY VEHICLE OR OBJECT. AS I SLAMMED ON MY BRAKES, MY FRONT DRIVERS SIDE AIRBAG AND 2 OF MY SIDE AIRBAGS INADVERTENTLY DEPLOYED. THE FRONT DRIVERS AIRBAG CRACKED THE TOP OF THE WINDSHIELD. PICTURES WERE TAKEN OF ALL THE VEHICLES INVOLVED AT THE SCENE, INCLUDING MINE. MY CAR WOULD NOT START, SO IT HAD TO BE PUSHED OFF THE ROADWAY AND TOWED TO MY HOME. THE NEXT DAY, MY INSURANCE COMPANY ALLSTATE SENT AN AIRBAG EXPERT TO MY HOME TO INVESTIGATE THE SITUATION ([XXX]) AND TO MAKE A DETERMINATION AS TO WHETHER THERE HAD BEEN A COLLISION. SHE TOOK HER OWN PICTURES, WHICH HAVE BEEN OBTAINED AND WILL BE PROVIDED TO NHTSA. SHE CONFIRMED AND REPORTED THAT NO CONTACT HAD BEEN MADE BY MY VEHICLE WITH ANY OTHER OBJECT OR VEHICLE. THERE WAS NO DAMAGE. THERE WAS NO COLLISION. ALTHOUGH I HAVE FULL COVERAGE, ALLSTATE HAS NOT OPENED A COLLISION CLAIM ON THIS VEHICLE. I HAVE NO CAR, NO RENTAL CAR BECAUSE THERE WAS NO COLLISION. THE CAR WAS TOWED TO BMW OF ANNAPOLIS 410-349-9312. THE ANALYSIS IS BEING HANDLED BY A TECH NAMED [XXX]. HE WAS UNABLE TO MAKE AN ACCURATE ASSESSMENT YESTERDAY, SO BMW CORPORATE HQ IN NJ HAS TAKEN OVER, [XXX]. THEY DETERMINE IF THERE IS A MANUFACTURERS DEFECT, I WILL NOT BE ABLE TO GET A CAR. I LOOKED UP THE RECALLS ON THIS VEHICLE AND IT INDICATED THAT THE MODEL WAS RECALLED. I CALLED BMW CUSTOMER RELATIONS TO INQUIRE ABOUT THE RECALL AND THE REPRESENTATIVE INFORMED ME THAT MY VEHICLE VIN NUMBER WAS NOT PART OF THE RECALL. I UNDERSTAND THAT NUMEROUS BMW OWNERS HAVE MADE A SIMILAR COMPLAINT ABOUT THEIR VEHICLE AND RECALLS ARE USUALLY INITIATED IN THIS MANNER. I PURCHASED A 2007 BMW X3 ON 7/10/14 FROM A DEALER. AT THE TIME OF PURCHASE THE AIRBAG WARNING LIGHT ON THE DASHBOARD WAS ILLUMINATED. WE CALLED THE LOCAL DEALER WHO TOLD US THAT THE REPAIR EVEN THOUGH IT IS FOR A SIGNIFICANT SAFETY FEATURE WOULD CAST ABOUT $1000.00, WHICH IS TOTALLY UNACCEPTABLE. THIS IS A MAJOR SAFETY FEATURE THAT HAS NOW BECOME A LIABILITY. BMW HAS HAD A RECALL ON PRIOR MODELS FOR THE SAME PROBLEM BUT I ASSUME NOW IT IS NOT CONSIDERED SIGNIFICANT.
