AIR BAGS:SENSOR:OCCUPANT CLASSIFICATION

BMW of North America LLC (BMW) is recalling certain model year 2006 325i, 325xi, 330i, 330xi sedans and 325xi sports wagons, model year 2007 328i, 328xi, 335i, 335xi sedans and 328i and 328xi sports wagons, model year 2006-2007 525i, 525xi, 530i, 530xi, 550i sedans and 530xi sports wagons, model year 2006 760i sedans, model year 2006-2007 750i, 750Li, and 760Li sedans, and model year 2006 X5 sports activity vehicles, equipped with certain seat types. The front passenger seat occupant detection mat that determines if and how the passenger frontal air bag should deploy in a crash may fatigue and develop cracks which could lead to a system failure.

Fix: BMW will notify owners with an interim notification letter in January 2014 since parts are not currently available. When parts are available, BMW sent a second letter in August and dealers will repair the occupant detection mat to eliminate the possibility that it may crack, free of charge. Additionally, owners of model year 2006-2007 3 Series with standard seats, 5 Series with comfort seats, and Z4 models, will receive an extended warranty on their front passenger seat occupant detection mat. A diagnostic scan found that the front passenger seat occupancy sensor is faulty — this sensor tells your car whether someone is sitting there. BMW issued a recall (13V-564) for vehicles made between December 2005 and September 2006 to fix this problem, and your car was made in June 2006, but BMW says your vehicle isn't covered by the recall. The fix would involve replacing the faulty occupancy sensor in the passenger seat.

THE VIN WITH THE LAST DIGIT AS A "2" WAS THE EXACT MODEL AS MY VEHICLE (YEAR, COLOR, INSIDE AND OUT, AND EQUIPMENT). BUT FOR SOME REASON MY VIN IS MISSING FROM THE RECALL. WE IMMEDIATELY CONTACTED THE PERILLO BMW DEALERSHIP IN CHICAGO (1035 NORTH CLARK STREET, CHICAGO, IL 60610, (312) 981-0000) WHERE WE PURCHASED THE CAR. OVER THE FOLLOWING SIX MONTHS, WE CALLED MONTHLY TO INQUIRE ABOUT WHETHER THEY HAD THE REPLACEMENT SEAT TO FIX THE CAR. PERILLO ACTUALLY HAD US BRING THE CAR IN TWO SEPARATE TIMES ONLY TO TELL US EACH TIME THAT THEY DIDN'T HAVE THE PART NEEDED FOR OUR TYPE OF REPAIR. WE HAPPENED TO HAVE THE WORST POSSIBLE OUTCOME WHERE THE SENSOR MAT IS BROKEN AND THE AIR BAG IS DISABLED ON THE PASSENGER SIDE OF THE VEHICLE. THE CONDITION OF THE CAR MAKES IT VERY DANGEROUS FOR ANYONE TO SIT IN THE FRONT PASSENGER SEAT. WE LIVE IN CHICAGO AND THEREFORE DRIVE ON HIGHWAYS AND IN HEAVY TRAFFIC FREQUENTLY. I AM THE ORIGINAL OWNER OF A 2006 BMW X5, VIN: [XXX]. IN THE EARLY YEARS OF OWNERSHIP THE PASSENGER SEAT OCCUPANCY DETECTION MAT WAS FAULTY AND WAS REPLACED. THIS AUGUST THE AIRBAG LIGHT ON THE INSTRUMENT DISPLAY WENT ON AGAIN AND AS A RESULT MY VEHICLE FAILED THE MASSACHUSETTS STATE INSPECTION SAFETY INSPECTION. IN SEPTEMBER OF THIS YEAR I BROUGHT MY X5 TO BMW TO HAVE BMW REVIEW THE AIRBAG ISSUE . THE TECHNICIANS AT BMW DIAGNOSED THE PROBLEM AS A FAILING PASSENGER SEAT OCCUPANCY MAT. THE TOTAL COST TO ME FOR REPLACEMENT OF THE FAILED PASSENGER SEAT OCCUPANCY MAT WAS $1,460.89 + MA SALES TAX OF $39.15. I RECENTLY FOUND THAT ON 11/18/2013 BMW ISSUED A RECALL RELATING THE FRONT PASSENGER SEAT OCCUPANT DETECTION MAT. THE RECALL CAMPAIGN FOR THE X5 PASSENGER SEAT OCCUPANCY DETECTION MAT IS IDENTIFIED AS #13V564000 I NEVER RECEIVED NOTIFICATION OF THIS SAFETY RECALL IN JANUARY OF 2014. I CALLED BMW THIS MORNING TO EXPLAIN MY ISSUE AND THEY ADVISED THAT THE NHTSA DID NOT INCLUDE THE VIN OF MY VEHICLE IN THE RECALL AND THEREFORE THEY WOULD NOT REIMBURSE ME. MY RESPONSE WAS THAT PERHAPS THE REPLACEMENT PASSENGER SEAT OCCUPANCY MAT THAT FAILED MANY YEARS AGO THAT BMW INSTALLED AS A REPLACEMENT WHEN MY VEHICLE WAS UNDER WARRANTY WAS IN FACT A PART THAT WOULD HAVE BEEN INCLUDED IN THE RECENT RECALL. THEY TOLD ME THAT I HAD A VERY GOOD POINT, AND THAT MAY BE THE CASE, BUT I WOULD HAVE TO WRITE TO NHTSA TO REQUEST THAT MY VEHICLE BE INCLUDED IN THE RECALL, OTHERWISE THEY WOULD NOT REIMBURSE ME. I HAVE CALLED BMW OF AMERICA AND TRIED TO GET THEM TO HONOR THE RECALL BUT THEY HAVE REFUSED. I WAS TOLD BY CUSTOMER REP. [XXX] THAT BMW HAVE DECIDED THAT MY VEHICLE WAS NOT UNDER THAT RECALL AND THAT I WOULD HAVE TO PAY TO GET IT LOOK AT BEFORE THEY WOULD CONCEDER ANY REPAIRS TO BE COVERED UNDER THESE RECALLS. I TOLD BOTH REPS AND ALSO SPOKE WITH SUPERVISOR [XXX] THAT THIS IS UNCALLED FOR SINCE IT MATCHES THE YEAR, MAKE, MODEL AND PACKAGE THAT IS BEING RECALLED. I FIRST TALKED WITH [XXX] AND ALL HE HAD DONE WAS GIVE ME A RUN AROUND THAT BMW WOULD LOOK INTO IT AND THAT I WOULD NEED TO HAVE IT CHECKED OUT BY A BMW SERVICE TECHNICIAN. I KEPT TELLING THEM THAT I WAS NOT GOING TO PAY FOR A DIAGNOSIS FOR SOMETHING THAT IS DEFECTIVE AND SHOULD BE REPAIRED UNDER THE RECALLS, BUT ONCE AGAIN I WAS TOLD BY [XXX] THAT I HAVE NO CHOICE BUT TO PAY TO HAVE IT LOOKED AT. I HAVE SENT MAY EMAILS AND HAD MANY PHONE CALLS WITH BMW AMERICA ABOUT THIS ISSUE AND I AM VERY UNSATISFIED WITH HOW THEY ARE HANDLING THIS ISSUE. I FEEL THEY DO NOT LOOK OUT FOR THEIR CUSTOMERS AND DON'T CARE IF THIS RECALL HURTS OR EVEN KILLS SOMEONE. IF THEY TRULY CARED THEY WOULD HAVE TAKEN IN THIS VEHICLE AND HAVE DONE THE DIAGNOSIS TO SEE IF IT IS THE PROBLEM AND HAVE IT FIXED BUT AS I HAVE EXPERIENCED WITH THIS ISSUE BMW DOES NOT CARE. I HAVE CONTACTED THE LOCAL DEALER TWO TIMES (AFTER MARCH), THE SECOND TIME TODAY. AFTER A LESS THAN COMFORTING DISCUSSION WITH THE LOCAL DEALER, I CONTACTED BMW NORTH AMERICA TO DISCUSS THE ISSUE. BMW NORTH AMERICA INFORMED ME THAT THEY DO NOT HAVE THE REQUIRED PARTS AND WHEN THE PARTS ARE AVAILABLE, WILL BE SENDING OUT A SECOND LETTER. HOWEVER, THEY COULD NOT GIVE ME ANY IDEA AS TO WHEN THIS WOULD HAPPEN. SO, I SIT NOW, 6 MONTHS AFTER RECEIVING THEIR FIRST LETTER WITH NO IDEA AS TO WHEN THE PROBLEM WILL BE SOLVED. AND, BY THEY WAY, MY VEHICLE HAS BOTH THE AIR BAG WARNING LAMP ON THE CONSOLE AND THE "PASSENGER AIR BAG OFF" LAMP ILLUMINATED .... THE RECALL NOTICE SAID THAT THE PARTS WERE NOT YET AVAILABLE TO FIX THE ISSUE BUT THAT THEY WOULD BE SHORTLY AND BMW WOULD SEND OUT A NOTICE ONCE THEY WERE AVAILABLE. MY VEHICLE WAS EXPERIENCING THE EXACT ISSUE DESCRIBED IN THE RECALL LETTER WHICH WAS 'THE AIR BAG WARNING LAMP ON THE INSTRUMENT CLUSTER AND THE FRONT "PASSENGER AIR BAG OFF" LAMP IN THE OVERHEAD CONSOLE ARE ILLUMINATED AT THE SAME TIME'. I TOOK MY CAR INTO A SERVICE CENTER (CENTER BMW IN SHERMAN OAKS, CA); THEY ACKNOWLEDGED THE RECALL AND TOLD ME TO COME BACK IN MARCH WHEN THE PARTS WOULD BE AVAILABLE. HAVE REPORTED TO BMW DEALER AND BMW NA; CUSTOMER SERVICE AGENT AT BMW NA INITIALLY INDICATED THEY MIGHT COVER IT BUT THEN REQUEST WAS DENIED BY MANAGEMENT. I HAVE REQUESTED THEY SIMPLY DEACTIVATE THE SENSOR AND LEAVE THE AIRBAG ON, WHICH WOULD SEEM TO BE A LOW-COST REPAIR. THEY HAVE STATED THERE IS NO SAFETY ISSUE IN DOING SO. THE STATED PURPOSE OF THE SENSOR IS TO PREVENT UNNECESSARY COST FOR AIRBAG REPLACEMENT AFTER AN ACCIDENT. THIS SEEMS TO BE A CLEAR DESIGN DEFECT: IF THE SENSOR FAILS, THE AIRBAG SHOULD BE LEFT IN THE ACTIVE CONDITION, NOT A DISABLED CONDITION. THE DEALER IS REQUESTING $1276 TO REPLACE THE DEFECTIVE SEAT SENSOR. BMW KNOWS THEY ARE MAKING MONEY OFF THIS REPAIR AND HAS NO INCENTIVE TO FIND A LOW COST REPAIR THAT WOULD SAVE LIVES. I CONTACTED BMW USA TO REPORT THE SAFETY FAILURE. BMW SAID IT WAS NOT COVERED AND HAS REFUSED TO OFFER ANY ASSISTANCE. HOWEVER, UPON ARRIVING AT BMW OF ROSEVILLE (CALIFORNIA), I WAS TOLD THAT THE RECALL DOES NOT APPLY TO MY CAR SPECIFICALLY (DESPITE THE DESCRIPTION IN THE RECALL ITSELF), AND THAT I WOULD BE REQUIRED TO PAY $175 FOR A DIAGNOSIS FEE, AND THEN BE FULLY RESPONSIBLE FOR THE COST OF REPAIRS. THIS IS A SIGNIFICANT SAFETY ISSUE THAT CURRENTLY HAS MY FAMILY'S LIVES AT RISK, BUT THE SERVICE DEPARTMENT AT ROSEVILLE BMW WAS COMPLETELY DISINTERESTED. REALIZING THAT I WOULD GET NO HELP FROM BMW OF ROSEVILLE, I HAVE SINCE TAKEN THIS ISSUE UP WITH NIELLO BMW IN SACRAMENTO. THEY HAVE BEEN MORE HELPFUL, BUT THERE IS STILL THE ISSUE OF THE VIN NUMBER. HOWEVER, UPON ARRIVING AT BMW OF ROSEVILLE (CALIFORNIA), I WAS TOLD THAT THE RECALL DOES NOT APPLY TO MY CAR SPECIFICALLY (DESPITE THE DESCRIPTION IN THE RECALL ITSELF), AND THAT I WOULD BE REQUIRED TO PAY $175 FOR A DIAGNOSIS FEE, AND THEN BE FULLY RESPONSIBLE FOR THE COST OF REPAIRS. THIS IS A SIGNIFICANT SAFETY ISSUE THAT CURRENTLY HAS MY FAMILY'S LIVES AT RISK, BUT THE SERVICE DEPARTMENT AT ROSEVILLE BMW WAS COMPLETELY DISINTERESTED. REALIZING THAT I WOULD GET NO HELP FROM BMW OF ROSEVILLE, I HAVE SINCE TAKEN THIS ISSUE UP WITH NIELLO BMW IN SACRAMENTO. THEY HAVE BEEN MORE HELPFUL, BUT THERE IS STILL THE ISSUE OF THE VIN NUMBER. THE VEHICLES SEAT OCCUPANCY SENSOR IS MALFUNCTIONING FOR NO PARTICULAR REASON WHICH WILL PREVENT FOR PASSENGER AIRBAG TO DEPLOY WHEN IT IS SUPPOSE TO IN THE EVENT OF AN ACCIDENT, MY VEHICLE IS NOT THAT OLD AND HAS NOT BEEN ABUSED BUT YET THIS ISSUE OCCURRED SINCE ABOUT LESS THAN A YEAR AGO, WHEN SOMEONE SITS IN THE PASSENGER SEAT THE WARNING LIGHT COMES ON THAT INDICATES THAT THE AIR BAG IS OFF AND THE AIRBAG WARNING LIGHT COMES ON AS WELL. I HAVE TRIED TO GET THE MANUFACTURER TO TAKE RESPONSIBILITY WITH NO LUCK, THEY WANT OVER A $1000 PLUS TO REPLACE THE SENSOR, MY ISSUE REMAINS UNRESOLVED; I RAN A CHECK FOR THIS ISSUE ONLINE AND FOUND THAT ALMOST EVERY BMW OWNER EXPERIENCES THE SAME ISSUE AND ALMOST EVERY BMW IN DIFFERENT RANGE OF RECENT YEARS AND DIFFERENT MODELS HAS THE SAME PROBLEM AND THIS IS A MASS-PRODUCED MANUFACTURER DEFECT THAT HAS GONE UNNOTICED. THIS IS A SAFETY ISSUE, IF I HAD BEEN IN AN ACCIDENT MY PASSENGER AIRBAG WOULD NOT DEPLOY, THIS ISSUE STILL REMAINS UNRESOLVED AS OF THIS DATE. THIS PROBLEM BEGAN ABOUT A YEAR AGO WHEN MY VEHICLE WAS ONLY ABOUT 3 YEARS OLD AND 45000 MILES AND HAS BEEN GETTING WORST WITH TIME, BEFORE IT WAS OCCASIONAL BUT NOW IT IS ALL THE TIME, THE REPAIR WOULD CONSIST OF TAKING THE ENTIRE PASSENGER SEAT OUT AND APART AND REPLACE THE SENSOR-PAD THAT IS CONNECTED TO THE VEHICLES SAFETY SYSTEM COMPUTER PLACED INSIDE THE SEAT PADS, THIS IS NOT AN EASY TASK OR A REPAIR THAT IS ACCESSIBLE. MOST DEFINITELY THERE SHOULD BE A SAFETY RECALL ON THIS ITEM.
